ACCEPTANCE OF TERMS
1. By interviewing for employment or by employing in any manner an applicant introduced by Everyday Staff Ltd, the client is deemed to have agreed to and accepted the following terms. The terms may not be varied except in writing by a Director of Everyday Staff Ltd at a time prior to an interview.
FEES
2. The fee payable by the Client to Everyday Staff Ltd is for the introduction of an applicant which results in that applicant being engaged by the Client either under a contract of service or a contract for services whether such an offer is made immediately or at any time within a six month period following the date of final interview, or initial introduction, whichever is the latter. For the avoidance of doubt ‘Introduction’ means the presentation of an applicant to the Client by Everyday Staff Ltd whether or not that applicant was known previously by the Client.
3. The fee payable will be calculated in accordance with the scale below. All fees are subject to VAT at the current rate.
Salary Range Fee
£0 - £14,999 15%
£15,000 - £19,999 17.5%
£20,000 - £24,999 19%
£25,000 + 20%
a) Salary is deemed to include the annual basic salary/wage.
b) If a salary is to be paid for a period of less than 12 months then the fee payable will be calculated at the percentage applicable as though such a salary were payable for 12 months and proportioned accordingly.
c) If the applicant is to work part time the fee scale percentage is that of the annualised salary pro-rata to the time actually being worked.
4. Should the Client fail to notify or disclose to Everyday Staff Ltd that an introduction has resulted in an engagement of an applicant then Everyday Staff Ltd reserves the right to charge the Client in accordance with the scale above. In such cases no refunds will be given should the applicant leave in the period covered by the rebate scheme.
5. All introductions are confidential. If a Client or any employee or representative of the Client refers the applicant to a third party within six months of the introduction, Everyday Staff Ltd reserves the right to invoice the Client with the introduction fee as though the Client had themselves engaged the applicant.
REBATES
6. Everyday Staff Ltd does not recognise trial periods. Should an applicant leave within eight weeks of commencing work, the Client will, subject to Clause 8, be entitled to a rebate as detailed overleaf.

Your company will qualify for a rebate as described in the table overleaf, if the applicant should leave for whatever reason, provided payment of our invoice has been made within 14 days of commencement of employment.

a) A rebate will not be given against fees changed under Clauses 4 & 5.
b) Should an applicant leave and be re-employed within a six-month period, the period of engagement will be considered continuous for the purpose of the above rebate calculation.
PAYMENT TERMS
7. The invoice is payable by the Client on the start date of the applicant or the invoice date whichever is the latter. On the starting date of an applicant from Everyday Staff Ltd the client accepts these terms are applicable again from this day. Late payment of an invoice may result in a surcharge being made. This will be calculated from the due date of the invoice at a rate of 26% per annum.
8. Should an invoice remain unpaid for 14 days after the due date, the client shall lose all rights to claim a rebate under the above scheme.
SKILLS & QUALIFICATIONS
9. Everyday Staff Ltd will endeavour to ensure that all applicants are suitable for the vacancy as described by the client. It does not, however, warrant the skill or ability of the applicant. It is the responsibility of the Client to ensure that references are taken up to satisfy himself that the applicant has the necessary qualifications and skills to perform the duties required of the applicant by the Client.
LIABILITIES
10. Everyday Staff Ltd accepts no liability of any kind for any loss or damage whatsoever or for any injury to or death of any persons arising directly or indirectly from the acts, errors or omissions of any applicant introduced by Everyday Staff Ltd even if such an act or omission is negligent, fraudulent or dishonest. Nothing herein shall have the effect of excluding or restricting liability for death or personal injury resulting from the negligence of Everyday Staff Ltd.
EQUAL OPPORTUNITIES / DISCRIMINATION INDEMNITY
11. Everyday Staff Ltd excepts that the client will be fully aware of all current laws relating to discrimination, victimisation or harassment due to race, colour, nationality, sex, marriage, disability or working time and that it has given the appropriate training to all members of its own staff that may be involved in the search, selection and interview process.

The client shall indemnify Everyday Staff Ltd against any and all claims, demands, liabilities, damages, costs and expenses incurred in action taken against Everyday Staff Ltd in respect of discrimination, unfair dismissal or other legal matters arising from any action and/or comment made or taken by any member of staff employed by the client.

GENERAL
12. The English/Scottish Courts shall have sole jurisdiction in any dispute arising regarding the construction and application of these terms.
